Put your proof of insurance and registration in one envelope, write the word POLICE on it, seal it, and place it in your glove compartment. Also, include your lawyer's business card or printed contact information if you have one.
NOTE: During most stops, if an officer sees you have a lawyer, he will act accordingly.
Immediately remove your paperwork from the compartment and place it on your dashboard. Take out your license and place your wallet back in your pocket for later. Then put your phone's camera on record and say what has transpired. Let your window down about 6 inches and keep your door locked. Once he reaches your window, he will see you are recording his actions. Immediately ASK HIM to turn on his body camera to record your stop. If it's already on or when he turns it on, ASK HIM for his name and badge number which he legally has to give you. ASK HIM why you were pulled over. Once he says why, don't argue or explain anything. Shut up and just keep recording until you're released or arrested. At this point your silence is golden.
NOTE
Don't be stupid! Once you turn on your phone's camera, DO NOT say anything on your phone that can incriminate you. This will be your evidence when you go to court. This will be played to the judge so keep it free of profanity and clear of things the judge will see problematic for you. This will be powerful evidence of the officer's wrongdoing! Don't mess up and let your ego take over.
NEVER EVER verbally agree to let an officer search your car WITHOUT PROBABLE CAUSE, no matter what reason he or she gives or how many times they ask or bargain with you. They may only do so if they obtain a search warrant from a judge. See probable causes. (Click here)
JUST SAY NO!
Say it every time he asks. This is the only question you may choose to answer. SAY NO or you just do not say anything when asked.
NOTE
Some officers illegally pretend to smell marijuana to justify probable cause. if you know you DO NOT have drugs or you know this to be a lie, ASK HIM on camera to bring the K-9 Unit to verify his claim. Officers know their camera cannot register the smell of marijuana, inevitably making it your word against his in court.
If an officer pulls you over for let's say a busted headlight, just wait for the citation/ticket. If he continues to ask about other things like where you are going, where you are coming from, or do you have anything in your car he needs to know about, just ASK HIM if you are being detained. He will try to intimidate you by asking if you have drugs or other substances in your car and what will happen if he finds something. DO NOT answer! At this point, he will immediately say he is going to call the K-9 Unit to check. After a dog search (if he does one), you can tell him to just give you the ticket so you can leave. ASK HIM if you are being detained again. Ask that question every time he asks any question not pertaining to the reason for the stop. If he continues his unlawful harassment, ASK HIM to call his supervisor to the stop.
If you are going to be arrested roll your windows up, remove your keys, get out, lock your doors, and place your keys and phone IN YOUR POCKET.
He can legally pat you down to search for a weapon but CANNOT reach inside your pockets or undergarments. This is not legal so let him know by saying to him, "I don't consent to a search." He can pat you down but CANNOT go into your pockets without your consent.
Reminder: Keep large sums of money and other valuables in an area not easily viewable upon looking into your vehicle.
If arrested, fill out a complaint or grievance form at the jail, right then and there. The longer you wait the less you'll remember. File a complaint every time you know your civil rights have been violated. Then most importantly, fill out an additional complaint with the ACLU.
